Terms and Conditions

Percep2 puts you in a room with people you have never met. That only works if everyone agrees on a small number of rules. These are them — written to be read, not to be skipped.

1 · The agreement

These Terms and Conditions are an agreement between you and Rafael da Silva Vergaças, established in Malta, who operates Percep2 ("we", "us"). By creating an account you confirm you have read and accepted these terms and the Privacy Policy.

If you do not accept them, do not create an account. You cannot send messages or create chats in Percep2 without accepting them first.

2 · Who can use Percep2

You must be at least 16 years old to create an account. This is checked at registration, and accounts found to belong to someone younger are deleted.

You must also have the legal capacity to enter into this agreement, and you must not be someone we have previously removed from the service.

3 · Your account

  • One account per person. Do not create accounts on behalf of anyone else.
  • Your email address must be real and belong to you — it is how you verify the account and recover access.
  • Your display name does not have to be your legal name, but it must not impersonate someone else.
  • You are responsible for keeping your password private, and for everything done through your account.
  • Tell us at support@percep2.com if you believe someone else has access to it.

4 · Community Rules

These are the behaviours and content that are not allowed in Percep2, anywhere in the app — area chats, Open Chats, Closed Chats, private messages, display names, bios and profile pictures alike.

  • No harassment. No bullying, stalking, intimidation, or repeatedly contacting someone who does not want to hear from you.
  • No hate speech. No attacking or degrading people on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity or sexual orientation.
  • No threats or violence. No threatening harm to anyone, inciting violence, or glorifying it.
  • No sexual content. No nudity, pornography, or sexually explicit material. No unsolicited sexual advances or sexually explicit messages to people who have not invited them.
  • Nothing involving minors. Any sexual content involving a minor, or any attempt to contact a minor for sexual purposes, results in immediate permanent removal and is reported to the authorities. There is no second chance and no appeal.
  • No sharing other people's private information. No posting someone's address, phone number, workplace, photographs or location without their consent.
  • No illegal activity. No selling or arranging the sale of drugs, weapons, stolen goods, counterfeit items or anything else prohibited by law.
  • No spam or scams. No bulk or repetitive messaging, no phishing, no fraud, no pyramid schemes, no unsolicited advertising.
  • No impersonation. Do not pretend to be another person, a business, or an official body.
  • No malicious software or links. No malware, no links designed to steal credentials or harm someone's device.
  • No interfering with the service. No bots, scraping, automated account creation, reverse engineering, falsifying your location, or attempting to access other people's accounts or data.

Percep2 is not a place to meet children and it is not a place to send anyone sexual material they did not ask for. Those two rules are enforced without discretion.

5 · Reporting and enforcement

You can block any user from their profile. A blocked user cannot message you, and you stop seeing them.

You can report any message or any profile from inside the app. Reports go to a person who reads them. Tell us what happened — the more specific you are, the faster it gets resolved.

Where a report is justified, or where we otherwise become aware of a breach, we may:

  • remove the content;
  • hide or deactivate a chat;
  • permanently delete the account.

Whenever we remove your content or delete your account, we will email you to say what we did and why — which rule was breached, the content concerned, and how to challenge it. Those decisions are made by a person, not automatically.

We act in proportion to what happened and how often. Serious breaches — threats, anything involving minors, sexual content sent to someone who did not ask for it — skip straight to permanent removal.

If you believe your account was removed in error, write to support@percep2.com and we will review it.

Reporting abuse to us is not a substitute for reporting a crime. If someone is in danger, contact the police.

6 · Your content

Your messages, profile picture and bio remain yours. We do not claim ownership of anything you write or upload.

To operate the app we need a limited licence: by posting content you grant us a non-exclusive, royalty-free licence to store, transmit and display that content, for as long as it exists on the service and solely for the purpose of running Percep2. That licence ends when the content does — which, given section 7, is soon.

You confirm that you have the right to post what you post, and that it does not infringe anyone else's rights.

7 · Messages expire

Percep2 deletes messages on a schedule: 7 days in Open Chats, 30 days in Closed Chats and private conversations. Open Chats themselves expire two hours after they are created unless converted to a Closed Chat.

This is how the product is meant to work. Percep2 is not a storage service and not a backup. Do not use it to keep anything you would be upset to lose, and do not expect to be able to retrieve a conversation later.

8 · Location

Percep2 needs your device's location to place you in the right area chat. You grant that permission through your operating system and can withdraw it at any time — the app's area features stop working, but your account remains.

Location accuracy depends on your device and your surroundings, and we do not guarantee it. Percep2 must not be relied on for emergencies, navigation, or any situation where being in the wrong place has consequences.

Deliberately falsifying your location to appear in an area you are not in is a breach of section 4.

9 · Meeting people

Percep2 connects you with strangers. We do not verify identities, run background checks, or vet anyone. A verified email address proves an inbox exists — nothing more than that.

If you choose to meet someone from Percep2 in person, you do so at your own risk. Meet in a public place, tell someone where you are going, and leave if you are uncomfortable. We are not responsible for the conduct of any user, online or offline.

10 · The service itself

Percep2 is provided as is. We do not promise it will be available without interruption, free of errors, or that anyone will be nearby to talk to — the app depends on other people being in your area, and in a quiet area it will be quiet.

We may change, suspend or discontinue any part of the service, and we may impose limits on use. Where a change materially affects you, we will give notice by email and on percep2.com.

Percep2 is currently free, including the Professional account type. If we introduce paid features in the future, the price and terms will be shown before you are asked to pay, and any purchase will be handled by Apple or Google under their own terms — including their refund policies.

Nothing you have today will be taken away and sold back to you without notice.

12 · Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under Maltese or EU law. Your statutory rights as a consumer are unaffected.

Subject to that, we are not liable for indirect or consequential loss, for lost data or lost messages, for the conduct of other users, or for anything arising from your use of the app that we could not reasonably have foreseen.

13 · Ending the agreement

You can end it at any time by deleting your account — immediately, from inside the app, without asking us.

We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we discontinue the service. Where the reason is not a serious breach, we will give notice.

Sections 6, 12 and 15 survive the end of this agreement.

14 · Changes to these terms

We may update these terms as the app changes. The date at the top always reflects the current version. Where a change is material, we will tell you by email and post it on percep2.com before it takes effect, and continuing to use Percep2 after that means you accept the new version. If you do not, delete your account.

15 · Governing law

These terms are governed by the laws of Malta. Disputes fall to the courts of Malta.

If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory consumer laws of your own country, and you may bring proceedings there.

16 · Contact

Anything about these terms, a report, or an account decision: support@percep2.com. This is also the single point of contact for users under the EU Digital Services Act, and we answer in English.

Authorities. Member State authorities, the European Commission and the European Board for Digital Services may contact us at the same address, in English.

Copyright and trademark. If something in Percep2 infringes your intellectual property, write to support@percep2.com with a link or description of the content, what right you hold, and your contact details. We remove infringing material.
